What is a Notarized Statement?

What is a Statement of Address?

This is a document that is an attachment to the Occasional Rental Agreement, required for this type of rental. If you are a tenant and want to sign an Occasional Tenancy Agreement with the landlord of the apartment, you must provide a statement from the owner of another apartment that you will be able to live at the indicated address in the event of eviction. Without this, you will not be able to sign the contract. So what if you’re a foreigner or simply don’t have registration in Poland, or don’t have friends/family who could sign such a statement? What does the Statement of Address contain?

  • It must include the First and Last Name of the owner of the designated apartment and also the PESEL number and ID number, as well as the address of residence. In the case of a Company or a firm, the full name and REGON and Tax ID number must be provided, as well as the details of its representative.
  • The full address of the designated premises, including the Land and Mortgage Register number.
  • Information dt. of the lease in question, i.e. First and last name of the owner of the apartment, the address of the apartment to be rented by the tenant, and the first and last name of the tenant or tenants. Important! The statement must contain the Name of the Tenant or Tenants who sign the Occasional Rental Agreement. It is not necessary to list all the people living with the tenant, as this can be solved with appropriate verbal wording such as. “Tenant Like Kowalski along with the people living with him.” Such a phrase is entirely sufficient for understanding the content of the document and is accepted by Notaries.
    The statement itself is in the form of the first person singular, but its series can vary. There is no single model statement, so it is possible that as a tenant you will encounter different versions of this document. Don’t worry! The most important thing is the data on the document, it must match the above information.

What type of certification should I choose?

  1. Statement of Address with owner’s signature.

This is nothing more than a statement with the required data and the handwritten or qualified signature of the owner of the designated apartment. This document is considered legally correct and accepted by notaries.

 

  1. Notarized Statement.

This is a statement that, like the Statement of Address with Owner’s Signature, contains all the required data and the handwritten or qualified signature of the owner of the designated apartment, but is additionally secured by a notary’s certification.

Notarization is nothing more than a confirmation of its authenticity. An attestation is added to the document, which includes the exact date and place where the documents were drawn up, the personal data of the person signing, as well as the signature and seal of the notary. The attestation clause gives us a presumption that the signature is authentic, and that the document on which it is affixed existed at the time of the attestation.

So what does a notarial certification provide? Additional security of the document and the assurance that it is not untrue.

 

Which statement to choose?

No single answer has this question, as it is often an individual matter. It’s always a good idea to ask the landlord of the apartment you want to rent or the notary where you will be submitting to voluntary execution about what documents they require from you. An affidavit with the owner’s signature and a notarized statement are correct documents and accepted by notaries.
